The Station HQ Pty Ltd ABN 85 671 378 448 ("we", "us", "our") respects your privacy and is committed to protecting personal information in accordance with the Privacy Act 1988 (Cth) (Act) and the Australian Privacy Principles (APPs). The Station HQ Pty Ltd is an Incorporated Legal Practice. Liability limited by a scheme approved under the Professional Standards Legislation. 


This Privacy Policy explains how we collect, use, disclose and store personal information when providing legal and business consultancy services. By engaging with us or using our services you agree to the terms and conditions of this Privacy Policy. 


We operate as a commercial law firm and business consultancy. In addition to our legal obligations under the Act, we are legal practitioners with strict professional obligations to our clients and the courts, including obligations of confidentiality. We routinely handle sensitive and confidential information, including information subject to legal professional privilege. We take this responsibility seriously and apply a high standard of care to how information is collected, used and protected.


1. What is Personal Information


"Personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable. This may include sensitive information (such as health, criminal or financial information) where it is reasonably necessary for the services we provide.


2. Our Approach to Privacy


We approach privacy in a way that is:


  • Practical – aligned with how legal, commercial and consulting work is actually delivered
  • Protective – applying confidentiality and privilege principles wherever relevant
  • Proportionate – only collecting what we need
  • Transparent – clear about how information is used and shared


3. What happens if we can't collect your Personal Information?


In most cases you will be required to identify yourself when you deal with us, such as when you (or your associated company or other entity) become a client of ours. 

If you do not provide us with the personal information required by us, some or all of the following may happen:


  • we may not be able to accept you (or your associated company or other entity) as a client or provide our services to you or your associated company or other entity;
  • we may not be able to provide you with our publications, brochures and newsletters; and
  • we may be unable to tailor the content of our website to your preferences and your experience of our website may not be as relevant as it could be.

  • If you are a client or potential client, information about your organisation and your role, information on other employees and management in your company, payment information and information about your legal matters

  • Communications with us (emails, calls, meeting notes, feedback, messages)

  • Interest in areas of legal practice, business, consultancy, services or events
  • Information provided by or on behalf of applicants for an employment role with us.


We only collect, use or disclose sensitive information about you if it is reasonably necessary for us to do so in order to perform our functions and if you have consented to us doing so, or if the law allows us to do so without that consent.


5. How we collect Personal Information


We collect personal information in a number of ways, including:

  • Directly from you or your agent or representatives (e.g. recruiters, staff or brokers)
  • From our clients when acting on their behalf

Where reasonable and practicable, we will collect personal information directly from you during the course of our business relationship.


Where it is not practicable or reasonable to collect your information directly from you, we may collect it from other sources. Information is often collected from our clients but may also be collected from sources such as your employer or colleagues, government registers, and online publications.

7. Personal information about our employees


We collect information in relation to employees and our contractors as part of the recruitment, application and onboarding processes, and during the course of their relationship with us. This is done either directly from them or from third parties such as recruitment agencies. 


This may include information about the person’s health, their right to work in Australia, or other sensitive information. Our people may need to undergo vetting, such as background checking or a criminal history search.


Personal information of our people may be disclosed to third parties in connection with the recruitment process, and otherwise in connection with their relationship with us and their work. These third parties are usually in Australia but may be based overseas. When disclosing our people’s information we ensure that the recipient is bound by an obligation of confidentiality, where it is lawful and appropriate to do so.


Under the Act, personal information about a current or former employee may be held, used or disclosed in any way that is directly connected to the employment relationship. We handle employee information in accordance with legal requirements and our applicable policies.


8. Disclosure of Personal Information


Subject to our professional obligations to our clients, we may disclose personal information to:


  • Parties as part of providing our services to our clients
  • Third party service providers, agents and contractors, examples include marketing firms and couriers
  • Clients and their authorised representatives
  • Professional advisors (e.g. barristers, experts, consultants)
  • Service providers (IT, cloud storage, payment processors)
  • Regulatory bodies, government agencies or law enforcement or as otherwise required or authorised by law
  • Queensland Law Society or Legal Services Commission
  • Insurers, insurance brokers and underwriters
  • Courts, tribunals, or dispute resolution bodies
  • Any party you provide consent to us in relation to the disclosure of your personal information 


We take reasonable steps to ensure third parties handle personal information in accordance with applicable privacy laws.


9. Overseas disclosure


We do not routinely disclose personal information overseas. 


Some service providers may be located overseas (for example, cloud or IT providers). Where personal information is disclosed overseas, we take reasonable steps to ensure it is protected in accordance with the Australian Privacy Principles, including through contractual safeguards.


10. Data Security and Storage


We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include:

  • Access controls and confidentiality obligations
  • Confidentiality obligations and security training for staff and contractors
  • Secure data transmission
  • Staff training and policies


Personal information may be stored in electronic systems (including cloud-based platforms) and physical files.

We retain personal information only for as long as necessary to:

  • Comply with legal and regulatory obligations
  • Resolve disputes and enforce agreements


When personal information is no longer required, we take reasonable steps to destroy or de-identify it.

Where we have a business relationship with you, or you have consented, we may send legal or business updates, or other communications, to you. We will use your personal information to send you details of our services, legal updates, invitations to seminars and events, and any other communication reasonably expected that you may wish to receive relating to our services or industry. 


You may opt out at any time if you no longer wish to receive our marketing information. You can make this request by using the contact details provided below, or by ‘unsubscribing’ from our marketing messages.


We do not disclose your personal information (including your email address) to any third party for the purpose of allowing them to market their products or services to you without first obtaining your consent.


13. Access and Correction


You may request access to, or correction of, your personal information by contacting us.

We will respond within a reasonable time and may require verification of identity, or may refuse access in limited circumstances as permitted by law.


We may recover our reasonable costs for giving access to your personal information. Please be aware that due to our professional obligations, we may not be able to confirm that we act for a particular client or whether we hold any information about any person at a particular time or at all.


14. Our website, cookies and website analytics


Our website may use cookies and analytics tools to improve user experience. When you visit out website we may send a “cookie” to your device. This is a small data file stored by your computer that impacts how we display information to visitors on our website. We also analyse website traffic to identify users and preferences for the purposes of updating our website. 


You can adjust your browser settings to disable cookies if preferred. As our website is on the internet, and the internet is inherently insecure, we cannot provide any assurance regarding the security of transmission of information you communicate to us online. We also cannot guarantee that the information you supply will not be intercepted while being transmitted over the internet. Accordingly, any personal information or other information which you transmit to us online is transmitted at your own risk.


Our website may contain links to other websites operated by third parties. We make no representations or warranties in relation to the privacy practices of any third party website and we are not responsible for the privacy policies or the content of any third party website. Third party website providers are responsible for informing you about their own privacy practices.


15. Enquiries & Complaints


If you have a complaint about how we handle personal information, please contact us. We will investigate and respond promptly, investigate within a reasonable time frame (within 30 calendar days) and provide a written response to you.

Privacy Collection Notice


Your personal information is being collected by The Station HQ Pty Ltd ABN 85 671 378 448 (we or us). Under the Privacy Act 1988 (Cth) (Privacy Act), we are required to tell you that we collect personal information (as defined in the Privacy Act) about you to assist in performing legal and business consultancy services you have requested and in promoting our legal and business consultancy services.  


If we cannot collect that information we may not be able to provide legal or business consultancy services to you.  We collect this information mainly through our communications with you but we may do so also from other sources in the course of providing our services to you.  We generally do not disclose information about you to any person except as required in the course of providing legal and business consultancy services to you or for the ordinary administration of our business.  In certain circumstances, we may disclose information about you where permitted or authorised under the Privacy Act or other applicable law.
 

Our Privacy Policy contains information about accessing and seeking correction of your personal information, making a privacy-related complaint and our complaint handling process.  It also lists the locations outside Australia where your information may be disclosed in accordance with this clause and our Privacy Policy.
